中英文句式不同，將英文法律文件譯成中文，二者差異格外明顯。有些英文語句不長，也不複雜，在翻譯成中文時，需要對譯文的句式作出調整。下面的例句供大家參考，舉一反三。具體的處理方法不拘一格，關鍵是首先理清原文的文法脈絡，理解語句的文義，不必拘泥于原文的句式。掌握了這樣的解題方法，就可以做到從心所欲而不逾矩。

【例句9】

Unless the contrary intention appears in this Constitution, an expression has, in a provision of this Constitution that deals with a matter dealt with by a particular provision of the Corporations Act, the same meaning as in that provision of the Corporations Act.  

【要點解析】

（一）

例句是一個主從複合句，文法脈絡非常清晰。

連詞unless引導條件狀語從句。乍一看到constitution，我們馬上想到它最常見的義項“憲法”。constitution也可以指公司、企業、社團的章程。在這裡它的意思就是“章程”。

(1)章程；組織制度

社團、政黨、工會、公司等組織所制定的組織原則、宗旨和規章制度；有時，社團、大學的章程也可稱「charter」，公司的章程稱「memorandum and articles of association」。

主句的主幹是an expression has the same meaning as in that provision of the Corporations Act

其中，主語是an expression，謂語是has，賓語是meaning，the same…as句型修飾賓語，作它的定語。

在法律文件中，expression除了“表達”這個義項，還有一個常用義項：詞句、言辭。參見《朗曼詞典》的解釋：awordor group of words with a particular meaning。https://www.ldoceonline.com/dictionary/expression

provision的意思是條文、條款。

介詞短語in a provision of this Constitution that deals with a matter dealt with by a particular provision of the Corporations Act是定語。

這個介詞短語含有一個定語從句that deals with a matter dealt with by a particular provision of the Corporations Act，修飾先行词a provision of this Constitution。在定語從句中，關係代詞that作主語，deals with作謂語，賓語是a matter，過去分詞dealt with作定語，修飾matter。

根據文義，定語從句的大意是章程的某個條文對某一事項作了規定，《公司法》的某個條文也對該事項作了規定。兩個deal with顯然是相同的意思。

deal with 是一個常用短語，它後面的賓語可以是人（somebody）也可以是物（something）。

根據《朗曼詞典》的解釋（https://www.ldoceonline.com/dictionary/deal-with），它有下面几个常用義項：

⑴ to take the necessary action, especially in order to solve a problem 處理，應付，對付，解決

⑵ if a book, speech etc deals with a particular subject, it is about that subject  講述，論述，探究

⑶ to do business with someone or have a business connection with someone 與某人打交道，交涉

⑷ to succeed in controlling your feelings about an emotional problem so that it does not affect your life  處理，解決（心情方面的問題）

原文中的deal with應當是第二個義項，可以根據文義譯成“規定”。

deal in也是法律英文中常用的動詞短語。要注意區分deal with和deal in。

deal in something 最常用在法律檔中最常用的義項是to buy and sell a particular type of product，即買賣、經營。比如經營古董/二手書：deal in antiques/second-hand books

如果按原文語序處理介詞短語in a provision of this Constitution that deals with a matter dealt with by a particular provision of the Corporations Act，譯文是這樣的：除非本章程有相反規定，本章程某一規定的內容如果在《公司法》特定條文中予以規定，該章程規定中所用表達的含義與該《公司法》特定條文中所用表達的含義相同。（學員習作）

凡《公司法》的特定條文對某一事項作了規定，本章程的條文亦對該事項作了規定，除非本章程表明相反的意圖，同一詞句在本章程的這一條文中與其在《公司法》的該特定條文中具有相同含義。
